When Hearings Arise

ABC administrative hearings can arise in various situations involving your liquor license. Common circumstances include:

  • ABC files an accusation against your license
  • Your license application is denied
  • Protests are filed against your application or transfer
  • ABC proposes to impose conditions on your license
  • You appeal an ABC decision
  • Local agency decisions require ABC review

Evidence & Documentation

The Administrative Hearing Process

ABC hearings follow a structured process. Understanding each stage helps you prepare effectively and know what to expect.

Notice and Scheduling

After a matter is set for hearing, you receive notice of the hearing date, location, and issues to be addressed. We help you understand what to expect.

Discovery and Preparation

We gather evidence, identify witnesses, and prepare your case. This includes reviewing ABC evidence and developing your defense or presentation.

Pre-Hearing Conference

Many cases include pre-hearing conferences to narrow issues, discuss settlement, or address procedural matters before the formal hearing.

Administrative Hearing

The hearing is conducted before an Administrative Law Judge. Both sides present evidence, examine witnesses, and make arguments.

Proposed Decision

The ALJ issues a proposed decision with findings of fact and recommended disposition. This goes to the ABC Director for review.

Director Decision

The ABC Director reviews the proposed decision and issues a final decision. The Director may adopt, modify, or reject the ALJ recommendation.

Potential Outcomes

Hearing outcomes depend on the facts, evidence, and legal arguments presented. Possible results include:

Dismissal

The accusation may be dismissed if ABC cannot prove the alleged violations or if procedural defects require dismissal.

License Retention

You may retain your license with conditions, probation, or other restrictions that allow continued operation.

Suspension

Your license may be suspended for a period of time. Some suspensions can be stayed pending compliance with conditions.

Revocation

In serious cases, the license may be revoked. This is permanent, though reapplication may be possible after a waiting period.
